This English text is a courtesy translation. In the event of any discrepancy, and for consumers resident in France, the French version (/cgv) prevails.

1. Legal information and publisher

The platform accessible at yeww.app (the "Platform") is published by [YEWW LEGAL ENTITY NAME], a [LEGAL FORM] with share capital of [AMOUNT] euros, registered with the Trade and Companies Register of [CITY] under number [SIREN/SIRET], with registered office at [FULL ADDRESS] (hereinafter "Yeww").

2. Definitions

  • "Platform": the yeww.app website and application and all of its services.
  • "Coach": the independent professional offering sports coaching, instruction, guiding or training services (notably MTB and snowboard), registered on the Platform.
  • "Rider" or "Client": any person booking a Service from a Coach via the Platform.
  • "Service": the sports coaching session provided by the Coach to the Rider.
  • "User": any Coach or Rider using the Platform.
  • "Booking": the request for a Service made by the Rider and subject to the Coach's acceptance.
  • "Take-home fee": the net amount the Coach wishes to receive per session, as set by the Coach on the Platform.
  • "Client price": the total amount paid by the Rider per session, calculated from the Take-home fee plus Yeww's commission (see Article 6).
  • "Commission": the fee received by Yeww for its intermediation service, equal to ten percent (10%) of the Client price.

3. Purpose and intermediary status (transparent agent)

Yeww operates an online marketplace whose sole purpose is the technical connection between independent Coaches and Riders, and the technical processing of the related payments.

Yeww acts solely as a technical intermediary and transparent collection agent ("mandataire à l'encaissement"). Yeww collects sums on behalf of the Coach and remits them to the Coach, less the Commission, in accordance with Article 6.

THE SPORTS SERVICE CONTRACT IS ENTERED INTO EXCLUSIVELY AND DIRECTLY BETWEEN THE COACH AND THE RIDER. Yeww is in no way a party to that contract. Yeww provides no sports service, sells no session, and is neither the employer, the principal, nor the commettant of the Coach.

The Coach carries out its activity entirely independently. The Coach freely sets its Take-home fee, availability, and the content and terms of its Services. No relationship of subordination exists between Yeww and the Coach.

In its capacity as transparent agent, Yeww is identified as such to Riders: the Rider knows at all times that they are contracting with the Coach and not with Yeww.

4. Registration and user accounts

Access to booking services requires the creation of an account. The Rider may also book as a guest, provided they supply a valid email address for the follow-up of their Booking.

The User warrants the accuracy of the information provided and undertakes to keep it up to date. The User is solely responsible for the confidentiality of their credentials.

Yeww reserves the right to suspend or delete any account in the event of a breach of these T&Cs, fraud, or the impossibility of verifying the professional information required under Article 8.

5. Booking process (request, acceptance, rejection)

The Rider selects a Coach, a date and a session type, then submits a Booking request.

The Booking is firm and final only after the Coach's express acceptance. Until the Coach has accepted, no Service contract is formed.

The Coach should accept or reject the request promptly. Until a response is given, the payment authorisation remains in place and no definitive charge is made. If the Coach rejects the request, or if the authorisation expires under Stripe or card-issuer rules, the hold is released and no charge is made.

Upon acceptance, a confirmation email is sent to the Rider and the Coach, summarising the essential details of the Service (Coach, date, meeting point, price, cancellation terms).

6. Financial terms, payment and commission

Payments are processed via Stripe Connect, provided by Stripe Payments Europe, Ltd. The Coach must hold an active Stripe Connect account and complete Stripe's identification process (KYC) to receive funds. Yeww is not a payment institution and does not store Users' full card details.

The Rider pays the Client price shown at checkout. This single price includes the Coach's Take-home fee and Yeww's Commission. No additional service fees are charged to the Rider at checkout.

The Client price, Take-home fee, Commission and Coach payout applicable to a Booking are fixed at the time the Booking is created and recorded on the Booking. Subsequent changes by the Coach to session prices on the Platform do not affect confirmed or pending Bookings already made.

Authorisation and capture (Auth-and-Capture):

  • At the time of the Booking request, the amount is authorised (pre-authorised) on the Rider's payment method. Funds are held but not definitively debited.
  • If the Coach accepts: the payment is captured and funds are collected by Yeww as agent on behalf of the Coach.
  • If the Coach rejects, or the authorisation is cancelled or expires: the hold is released with no debit. The time for funds to reappear depends on the Rider's bank.

Commission and payout:

  • The Coach sets a Take-home fee per session type. The Client price is calculated by adding Yeww's commission of ten percent (10%) to that Take-home fee (for example, a Take-home fee of €450 corresponds to a Client price of €500, comprising €450 for the Coach and €50 Commission for Yeww).
  • Yeww receives the Commission; the Coach receives the Take-home fee recorded on the Booking. Amounts are not recalculated if the Coach later changes prices on the Platform.
  • The Coach's Take-home fee is transferred via Stripe Connect after the session is marked complete. Bank payout timing is governed by Stripe.
  • Stripe processing fees are borne by Yeww and are not deducted from the Coach's Take-home fee, unless expressly notified otherwise.
  • The Coach remains solely responsible for invoicing the Rider for the coaching portion of the Client price. Yeww may invoice the Coach for its Commission. Platform reporting obligations (including DAC7) are reserved.

7. Cancellation, withdrawal and refunds

Cancellation terms and refund arrangements are detailed in the Cancellation Policy (/cancellation-policy), which forms part of these T&Cs.

In accordance with Article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure services supplied on a specific date or for a specific period. The Rider acknowledges that no right of withdrawal applies once the Booking has been accepted by the Coach.

Cancellation of a Service due to weather, safety conditions or force majeure is a matter for the Coach and the Cancellation Policy. Yeww does not intervene in that decision.

8. Coach professional obligations and verifications

The Coach declares and warrants compliance with applicable French law, and in particular holds, under Article L212-1 of the French Sport Code, a professional qualification allowing it to teach, lead, guide or coach the relevant activity for remuneration.

The Coach undertakes to hold and keep valid throughout registration: (a) its professional card (carte professionnelle) as a sports educator issued by the competent authority (DRAJES / SDJES); (b) professional civil liability insurance (RC Pro) covering its coaching activity; (c) a valid business registration (SIRET) with the competent bodies.

Being a national of another EU Member State does not prevent practising in France, subject to compliance with the Sport Code.

Yeww carries out a good-faith documentary check of supporting documents before a profile goes live ("verified"). This check is marketplace due diligence and shall not be construed as a guarantee or certification of the Coach. The Coach remains solely responsible for the validity and renewal of its documents.

The Coach is solely responsible for tax and social declarations (URSSAF, income tax, VAT where applicable). Yeww makes no withholding at source and is not the Coach's employer.

9. Liability and exclusions

Yeww provides a technical booking and payment infrastructure. Its obligation is limited to a best-efforts obligation relating to the proper functioning of the Platform.

As Yeww is not a party to the Service contract, Yeww shall not be held liable, to the extent permitted by law, for: personal injury or death during a Service; the quality or safety of the Service; cancellations or delays; weather or force majeure; disputes between Coach and Rider; User conduct; or Platform or third-party failures.

The Coach is solely responsible for safety, risk assessment and the Rider's suitability. The Rider acknowledges inherent sporting risks and declares they have the required physical condition.

Save in cases of gross negligence or wilful misconduct, Yeww's liability towards a User is limited to the Commissions actually received for the relevant Booking.

10. Personal data (GDPR)

Yeww processes personal data in accordance with the GDPR and the French Data Protection Act. See the Privacy Policy (/privacy).

Stripe processes payment data according to its own contractual documentation.

11. Intellectual property

The "Yeww" trademark, logos and Platform content are protected. Content published by Coaches remains their property; the Coach grants Yeww a licence to use it solely to operate the Platform.

12. Amendment of the T&Cs

Yeww may amend these T&Cs at any time. The applicable version is the one in force on the date of the Booking. Users are informed of material changes.

13. Governing law, mediation and jurisdiction

These T&Cs are governed by French law.

Failing amicable resolution, disputes shall be brought before the competent courts of [CITY], subject to mandatory consumer rules.

14. Acceptance

Use of the Platform and any Booking entail full acceptance of these T&Cs. Coaches further accept the specific terms in Articles 3, 6, 8 and 9.
